Terms and Conditions
Working draft for British Virgin Islands legal review · Last updated 8 September 2026
1. Scope
These terms govern use of this website and payments made to Unlimited Potential, operated by Colin A. Gunthrope in the British Virgin Islands. A signed proposal, statement of work, or institutional service agreement may contain additional terms. If there is a conflict, the signed agreement controls for that engagement.
2. Services
Unlimited Potential provides executive performance architecture through Covenant Leadership, including institutional diagnostics, leadership intensives, transformation series, embedded partnerships, keynote speaking, facilitated sessions, and related curriculum or advisory support agreed in writing. Engagements are architected for the client context and are not represented as clinical, legal, financial, or medical services.
3. Assessment and Website Information
The Covenant Leadership Readiness Assessment and website materials are educational and reflective. Results do not constitute a diagnosis, professional certification, or guarantee of leadership performance. Website content may not capture every condition relevant to a proposed engagement.
4. Proposals, Booking, and Scope
An enquiry or consultation does not create an engagement. Scope, responsibilities, dates, deliverables, fees, and payment milestones are confirmed in writing. A booking is secured only when the written conditions for that engagement have been satisfied.
5. Payments
Fees are quoted and charged in United States Dollars unless agreed otherwise in writing. Clients using the payment page must enter the amount and reference stated in their proposal or invoice. Card payments are processed through PowerTranz. Payment does not alter the scope, schedule, or deliverables recorded in the applicable agreement.
6. Client Responsibilities
Clients are responsible for providing accurate information, identifying authorised decision-makers, making participants reasonably available, securing appropriate venues or technology where agreed, and meeting the responsibilities stated in the engagement document.
7. Cancellation, Rescheduling, and Refunds
The applicable engagement document and our Refund and Cancellation Policy govern cancellations, rescheduling, and refunds.
8. Intellectual Property
Covenant Leadership, the Contract vs. Covenant framework, the Engine Room, Ghost Story, Downstream Default Diagnostic, and related materials remain the intellectual property of Colin A. Gunthrope and Unlimited Potential unless expressly agreed otherwise. Client use is limited to the internal purpose and licence stated in the engagement document. Materials may not be reproduced, sold, published, or commercially exploited without written permission.
9. Confidentiality and Public Reference
Confidential client information is handled with discretion and subject to the applicable agreement and law. Neither party may use the other party’s name, logo, testimonial, confidential information, or engagement details publicly without appropriate permission and agreed wording.
10. Outcomes and Liability
Leadership and institutional change depend on factors beyond the control of Unlimited Potential, including participation, decision-making, implementation, and operating conditions. No specific organisational or individual outcome is guaranteed. Any limitation of liability should be interpreted with the applicable engagement agreement and British Virgin Islands law.
11. Force Majeure
A party is not responsible for delay caused by events reasonably beyond its control, including severe weather, disaster, illness, infrastructure failure, government action, or travel disruption. The parties will work in good faith to reschedule or adapt delivery.
12. Governing Law and Contact
These website terms are governed by the laws of the British Virgin Islands. Questions should first be addressed in good faith to Unlimited Potential.
